Terms & Conditions

In short: CargaSur is a neutral marketplace that connects shippers and carriers. We are not a freight broker, we are not a carrier, and we never take possession of, or responsibility for, the cargo being transported. Shippers and carriers deal with each other directly and are each responsible for their own agreements, payments, insurance, and compliance with applicable law.

01Acceptance of these Terms

By creating an account, accessing, or using CargaSur (the "Platform"), operated by RMG Group USA ("CargaSur," "we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Platform.

02What CargaSur is — and is not

CargaSur is a technology platform that connects two types of independent users: Shippers, who post loads that need to be transported, and Carriers, who transport those loads.

A Carrier's responsibility under the Platform is limited to the transportation of the load between the agreed pickup and delivery locations. Loading and unloading the cargo — including any labor, equipment, or assistance needed to load it onto the vehicle or unload it at destination — is the Shipper's responsibility, unless the Shipper and Carrier separately agree otherwise between themselves.

        CargaSur is not a freight broker, a motor carrier, a shipping agent, or a party to any transportation agreement. We do not arrange transportation on behalf of any user, we do not dispatch, supervise, or direct any driver or vehicle, and we do not take possession, custody, or control of any cargo at any point. Our role is limited to providing the software that lets Shippers and Carriers find each other, communicate, and manage their own bookings.
      

03No responsibility for cargo

CargaSur is not responsible or liable for the cargo transported as a result of connections made through the Platform, including but not limited to:

Loss, theft, damage, delay, spoilage, or destruction of cargo
Accidents, injuries, or property damage occurring during transport
Disputes between Shippers and Carriers regarding rate, condition, delivery, or performance
The accuracy of information posted by any user (load details, addresses, weight, equipment, licensing, or insurance)

Shippers are responsible for obtaining appropriate cargo insurance. Carriers are responsible for maintaining appropriate motor carrier liability insurance and cargo insurance as required by applicable federal and state law.

04Independent users, independent agreements

Shippers and Carriers contract directly with one another. Any rate confirmation, agreement on payment terms, delivery timeline, or handling instructions is a private agreement between those two parties. CargaSur is not a party to, and assumes no obligation under, any such agreement.

Payment for the transportation of goods is handled directly between the Shipper and Carrier, outside of the Platform, using whatever method they agree to. CargaSur only processes payment for the Platform's own access fees (membership subscriptions or per-load access fees), never for the value of the freight itself.

A user who fails to pay another user as agreed for a completed shipment may have their CargaSur account suspended, based on reports received. CargaSur is not a party to the underlying payment agreement and does not adjudicate payment disputes, but reserves the right to suspend access to the Platform to protect the integrity of the marketplace.

Shippers and Carriers may not use contacts, information, or introductions obtained through the Platform to arrange future loads directly with one another outside of CargaSur in order to avoid Platform fees. Attempting to do so is a material breach of these Terms and may result in suspension or termination of your account.

05Carrier eligibility & compliance

Carriers are solely responsible for maintaining any authority, licensing, permits, and insurance required to legally operate as a motor carrier under applicable federal (including FMCSA) and state regulations. Where a Carrier certifies information about their driving record, criminal history, licensing, or equipment through the Platform, CargaSur relies on that self-certification in good faith and does not independently verify it unless explicitly stated otherwise. Shippers are encouraged to independently verify a Carrier's safety record (for example, through the FMCSA SAFER system) before engaging them.

Where CargaSur manually reviews a Carrier's insurance or vehicle registration document, that review only confirms that a document matching the expected format was submitted. It does not constitute a guarantee that the document is valid, current, or that the coverage is adequate for any particular shipment. Shippers remain responsible for conducting whatever additional verification they consider necessary before entrusting a load to a Carrier.

06Account registration

You must provide accurate, current information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

07Prohibited conduct

Posting false, misleading, or fraudulent load or carrier information
Using the Platform to facilitate illegal transportation of goods
Circumventing or attempting to circumvent Platform fees
Harassing, threatening, or abusing other users
Attempting to interfere with the security or normal operation of the Platform

08Disclaimer of warranties

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. CargaSur does not warrant that the Platform will be uninterrupted, secure, or error-free.

09Limitation of liability

To the maximum extent permitted by law, CargaSur and RMG Group USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Platform, including any loss, damage, or dispute related to cargo transported as a result of a connection made on the Platform. In no event shall CargaSur's total liability exceed the amount of fees you paid to CargaSur in the twelve (12) months preceding the claim.

10Indemnification

You agree to indemnify and hold harmless CargaSur and RMG Group USA from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or the rights of a third party.

11Termination

CargaSur may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the Platform.

12Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, and any disputes shall be resolved in the state or federal courts located in Florida.

13Changes to these Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
